These Terms of Service (hereinafter referred to as the “Terms”) constitute a legal agreement between KEY CREATION inc. and KEYCRE inc. (hereinafter collectively referred to as the “Group,” “we,” “us,” or “our”) and the user (hereinafter referred to as the “User” or “you”) concerning the use of the game application and related services provided by the Group (hereinafter referred to as the “Service”).

1. Acceptance of Terms

  1. 1.By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms.
  2. 2.If you do not agree to these Terms, you may not use the Service.
  3. 3.Minors: If you are a minor (under the age of majority in your jurisdiction), you represent that you have obtained the consent of a parent or legal guardian to use the Service and to agree to these Terms.

2. Grant of License

  1. Subject to your compliance with these Terms, the Group grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial entertainment purposes.

3. In-App Purchases and Virtual Currency

  1. 1.Virtual Items: The Service may allow you to purchase virtual currency (e.g., coins, gems) or virtual items (collectively, “Paid Content”) using real-world money.
  2. 2.Payment: All purchases are processed through third-party platforms (such as the Apple App Store or Google Play Store). You agree to comply with the terms and conditions of the applicable third-party platform.
  3. 3.No Ownership Rights: You acknowledge that you do not own the Paid Content. You only acquire a limited license to use the Paid Content within the Service.
  4. 4.No Refunds: All sales are final. Except as required by applicable law, the Group will not provide refunds or exchanges for any Paid Content for any reason, including but not limited to accidental purchases or unused balances upon account termination.
  5. 5.Expiration: The Group reserves the right to regulate, manage, modify, or eliminate Paid Content at its sole discretion.

4. Intellectual Property Rights

  1. All rights, title, and interest in and to the Service (including but not limited to computer code, themes, objects, characters, names, stories, artwork, animation, sounds, and musical compositions) are owned by the Group or its licensors. You may not copy, distribute, or create derivative works based on the Service without prior written consent.

5. Prohibited Conduct

  1. You agree not to engage in any of the following acts:
  2. ● Using cheats, automation software (bots), hacks, or any unauthorized third-party software to modify or interfere with the Service.
  3. ● Buying, selling, or trading your account or Paid Content for real-world money (Real Money Trading).
  4. ● Harassing, threatening, or defaming other users or Group employees.
  5. ● Reverse engineering, decompiling, or disassembling the Service.
  6. ● Using the Service for any illegal or unauthorized purpose.

6. Termination

  1. The Group reserves the right to suspend or terminate your access to the Service at any time, without notice, if we believe you have violated these Terms. Upon termination, your license to use the Service and any Paid Content will immediately cease.

7. Disclaimer of Warranties

  1. The Service is provided on an “as is” and “as available” basis. The Group makes no warranties, express or implied, regarding the operation of the Service, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

8. Limitation of Liability

  1. To the fullest extent permitted by law, the Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, arising out of or in connection with your use of the Service.

9. Governing Law and Jurisdiction

  1. These Terms shall be governed by and construed in accordance with the laws of Japan. Any dispute arising out of or in connection with these Terms or the Service shall be submitted to the exclusive jurisdiction of the Tokyo District Court in the first instance.
